  • What is a criminal record certificate?

    In Italy, the so-called Certificato Penale (also known in English as Criminal Record Certificate, Police Certificate, Background Check, Judicial Records Register, PCC, Police Check, Certificate of Character or Police Clearance Certificate) is actually made up of 2 distinct certificates:

    • The CERTIFICATE OF JUDICIAL RECORDS (Certificato del Casellario Giudiziale in Italian language) , which indicates whether or not there are any criminal convictions, sentences, and final judgments in civil, criminal, and administrative matters.
    • The CERTIFICATE OF PENDING CHARGES (Certificato dei Carichi Pendenti in Italian language), which indicates whether or not there are any ongoing criminal proceedings.

    It is therefore advisable to produce both certificates to fully attest to one's status and to prove the absence of criminal records in Italy, even for the period of residence only. Many authorities and foreign immigration and visa offices require both certificates (e.g., USA, Canada, Australia, New Zealand), while for others, only the Certificate of Judicial Records is sufficient.

    Starting from 26/10/2019, the Italian Certificate of Judicial Records also includes an extract of the European Criminal Records Information System (ECRIS) for Italian citizens and completely replaces the former Criminal Record Certificate and the Civil Certificate of Judicial Records.

  • What is a criminal record certificate used for?

    Often both these certificates (or sometimes only the Judicial Records Register) are requested for employment, work requirements, competitions, legal matters, airlines, registrations with professional associations, political and voting rights, citizenship, immigration, visas, etc.

    For visa/immirgration purposes BOTH of them are mandatory for Australian, Canadian, US, New Zealand authorities.

  • Who issues a criminal record certificate?

    The issuance is carried out by the competent Public Prosecutor's Office.

    The Public Prosecutor's Office requires the following stamp duties for each certificate:

    • € 16.00 for the issuance of the certificate + € 3.92 for the certificate fee (regular issue within 5 baking days)
  • In which cases is the certificate exempt from stamps?

    The issuance is exempt from the stamp duty of £16.00 - for example - for:

    • Adoption procedures
    • Custody of minors (art. 82 Law 184/83)
    • Labour, mandatory social security and welfare disputes (art. 10 Law 533/73)
    • Free legal aid (art. 18 DPR 115/2002)
    • Application for redress of judicial error (art. 176 disp. arr. c.p.p.)
  • How much does a criminal record certificate cost?

  • How can I request a criminal record certificate?

  • Can I request a criminal record certificate even if I am abroad?

    We are able to issue the certificate even if the individual resides abroad without any problems, as well as deliver it quickly to their home by express courier.

  • How can I use a criminal record certificate abroad?

    CAESAR in Rome can also quickly affix the APOSTILLE or CONSULAR LEGALISATION/ATTESTATION on the certificates, so that they are legally valid abroad.

  • What is the expiry of a criminal record certificate?

    The certificates are valid for 6 months from the date of issue; therefore, it is necessary to obtain an updated certificate if the previous one has expired.

    Please, note that some Countries require these certificates issued within 3 months.

  • Which certificates are required?

    Usually, US (USA), Australian (Australia), Canadian (Canada), and New Zealand authorities require BOTH Italian certificates for visa or immigration purposes.

  • How long does it take to obtain a criminal record certificate?

    We are able to issue the certificate within 5 working days (or 1 banking day in case or urgent issue) from payment; this is the shortest possible time, as since 21/01/2021, the Office of Judicial Records no longer offers urgent issuance in 1 working day.
